US regulatory and operating context

  • Card payments. Any business that accepts card payments must meet the Payment Card Industry Data Security Standard (PCI DSS) at the level set by its acquirer. Point-to-point encryption, tokenization and network segmentation can reduce how much of your environment is in scope. We help you prepare; your acquirer and qualified assessors confirm compliance.
  • Guest privacy. There is no single federal privacy law. Guest information such as identification, stay history and preferences is governed by the FTC Act, state privacy laws (such as California's CCPA/CPRA and the Texas Data Privacy and Security Act, which have thresholds and exemptions) and state breach notification laws. Collect only what you need and keep it secure.
  • Marketing consent. Promotional emails must follow the CAN-SPAM Act, and marketing calls and texts to guests need consent under the TCPA, with a working opt-out.
  • Accessibility. Hotels, restaurants and attractions are public accommodations under ADA Title III, and courts apply it to booking websites and apps, so aim for WCAG 2.2 AA. Hotels have additional obligations to describe the accessibility features of rooms on their reservation channels.
  • Taxes. Systems must handle state and local sales tax and local lodging (occupancy) taxes correctly.
